Recent actions by the United States Congress related to events in Korea have caused some officials in Seoul to question the motivation and the role of the legislature in U.S. policy making. The first issue involves an invitation to a senior North Korean former-official, Mr. Hwang Jang-yop, to visit Washington. The second issue involves a letter of inquiry from eight House members to President Kim Dae-jung regarding government pressure on the independent South Korean media. As South Korea is a partner on the front-line of freedom and democracy in the Asia-Pacific region,[link widoczny dla zalogowanych], the American Congress is motivated by concern about the preservation of Korean human rights and democracy, which -- as Ronald Reagan proved -- has a direct impact on our respective national security.
Throughout President Reagan's engagement policy with Soviet leaders,[link widoczny dla zalogowanych], while facing often-critical domestic media, his commitment to freedom of the press and speech,[link widoczny dla zalogowanych], at home and abroad, contributed to a peaceful resolution of the Cold War. The President worked with the Congress to craft policies, sometimes through contentious debate, which laid the foundation for the triumph of freedom's forces. This was especially important to the people of South Korea, who were nearly abandoned by the Carter Administration to a fate of either Communist conquest or military rule. Although we are entering a new period of world history, the connection between national security and democratic freedom, whether on the Korean peninsula or in Washington,[link widoczny dla zalogowanych], remains relevant.
The United States and South Korea are both governed by elected officials. However, the U.S. Congress appears to have a much greater partnership with the Executive Branch based on its "advise and consent" role. This relationship was established by America's Founding Fathers to prevent the emergence of an "Imperial Presidency." Among the responsibilities of Congress as mandated in the Constitution are the power to proscribe and collect taxes,[link widoczny dla zalogowanych], to declare war, to raise and support armies, and to make all laws necessary for the execution of U.S. Government power. Congress, which has checks and balances through the relationship of its two chambers - the House and Senate - also appropriates and withholds funding for domestic and international operations,[link widoczny dla zalogowanych], as well as has the role of oversight of the executive Branch and its policies.
Oversight of America's foreign policy is conducted by a consortium of House and Senate panels, including the Foreign Relations,[link widoczny dla zalogowanych], Appropriations, Armed Services and Intelligence committees. These Committees consult regularly with the President's office and Executive agencies, including closed and public hearings on vital issues and policies. There are many occasions when the Congress, elected by the people to represent their interests, are in conflict with policies mandated by the unelected federal bureaucracy that advises the President,[link widoczny dla zalogowanych], such as the Department of State, the Internal Revenue (Taxation) Service or even the shadowy Central Intelligence Agency. It is the role of Congress to assure that the President does not unfairly use any of the federal agencies to harass or suppress his domestic critics or rivals.
And the Congress also has the responsibility to assure that America's foreign policy upholds the internationally recognized values, championed by our Founding Fathers, of basic democratic freedom and human rights.
It is within the above-mentioned constitutional responsibilities that members of the U.S. Congress have recently written to President Kim Dae-jung regarding the travel of Mr. Hwang Jang-yop and the National Tax Service's pressure on independent South Korean media. These issues are being considered separately from questions about the "Sunshine Policy," toward North Korea. However, there is an increasing appearance that rather than the "sunshine" of openness or democracy seeping into the North, that shadows of repression may be emerging in the South. Fundamental liberties such as the right of Mr. Hwang to travel and speak freely in Washington, or the ability of press and television outside of government control to freely report events or express their views are of the utmost interest to the U.S. Congress.
In the case of Mr. Hwang, as the "father of the juche philosophy," there is much valuable insight that U.S. officials can learn from him about North Korea. This is especially relevant because the North has not downsized their military forces that threaten South Korea,[link widoczny dla zalogowanych], nor have they stopped transferring missile technology to rogue nations. The United States government has guaranteed Mr. Hwang's security,[link widoczny dla zalogowanych], as earlier requested by President Kim. Yet, President Kim still objects.
The rapid response of the South Korean embassy to the Congress regarding the taxation harrassment of the independent Korean media rings hollow, based on the intensity and the unprecedented number of taxation agents that Kim Dae-jung has assigned. This tactic against the press was previously used by undemocratic Korean military regimes. The U.S. Congress will be watching this matter closely. The next step could be the introduction of a congressional resolution critical of Kim Dae-jung's media harrassment policies.
It is understandable,[link widoczny dla zalogowanych], given the lack of tolerance shown toward his domestic critics, that President Kim Dae-jung and his aides are critical of so-called "interference" by the U.S. Congress. However, it may be worthwhile that he reflect on the days when he was the object of the wrath of ruling officials. In the face of reluctance by the U.S. Executive branch bureaucracy to quickly intervene on his behalf, it was the U.S. Congress that advocated for his freedom. This was not because of the power of his personality,[link widoczny dla zalogowanych], but because of America's respect for democratic freedom for the people on both sides of the Korean peninsula. That respect still holds true today.
